Copyright protection and takedown procedures

Exam-PDF respects the intellectual property rights of others. This page outlines our policies and procedures for reporting claims of copyright infringement, in accordance with the Digital Millennium Copyright Act (DMCA).

1. Our Commitment

Exam-PDF ("we," "us," "our") is committed to respecting and protecting the intellectual property rights of others. We expect our users to do the same. We comply with the Digital Millennium Copyright Act of 1998 (DMCA) and respond promptly to clear notifications of alleged copyright infringement that comply with the DMCA and other applicable laws[reference:0].

2. Reporting Copyright Infringement (DMCA Takedown Notice)

If you are a copyright owner or an agent authorized to act on behalf of a copyright owner, and you believe that your copyrighted work has been copied, displayed, or made available on Exam-PDF in a way that constitutes copyright infringement, you may submit a written notification of claimed infringement (a "DMCA Takedown Notice")[reference:2].

To be effective under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3), your notice must include the following information[reference:3][reference:4]:

  • Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed.
  • Identification of the infringing material: A description of the material that is claimed to be infringing, with sufficient detail for us to locate it. Please include the full URL of the page where the material appears.
  • Your contact information: Your name, mailing address, telephone number, and email address.
  • Good faith belief statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy and authorization statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Important: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys' fees[reference:5].

3. Where to Send Your DMCA Takedown Notice

All DMCA Takedown Notices should be sent to our Designated Copyright Agent at the following address:

We recommend using the subject line "DMCA Copyright Infringement Notice" to ensure your notice is processed promptly.

4. What We Do When We Receive a Valid Notice

Upon receiving a DMCA Takedown Notice that substantially complies with the requirements outlined above, we will take the following actions[reference:6]:

  • Remove or disable access: We will expeditiously remove or disable access to the material that is claimed to be infringing.
  • Notify the user: We will take reasonable steps to notify the user who submitted the material that it has been removed or disabled.
  • Document the notice: We will retain a copy of the notice and the actions taken for our records.

Removal of material is not, and should not be construed as, an admission that any infringement has occurred[reference:7].

5. Counter-Notification (For Users)

If your material has been removed or disabled as a result of a DMCA Takedown Notice, and you believe that the removal was the result of a mistake or misidentification, you may submit a written counter-notification[reference:8].

Under 17 U.S.C. § 512(g)(3), your counter-notification must include the following[reference:9]:

  • Your physical or electronic signature.
  • Identification of the material: Identification of the material that has been removed or disabled, and the location at which it appeared before removal.
  • Good faith belief statement: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
  • Your contact information: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, that you consent to the jurisdiction of any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of that person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complainant. If the original complainant does not notify us within 10 business days that they have filed a court action seeking a court order to restrain the user from engaging in infringing activity relating to the material, we will restore the material.

6. Repeat Infringer Policy

Exam-PDF maintains a policy of terminating, in appropriate circumstances, users who are repeat infringers of copyright. We reserve the right to terminate access to our services for users who have been found to repeatedly infringe the copyrights of others[reference:10].

We may also, in our sole discretion, terminate access to users who are the subject of multiple DMCA Takedown Notices, even if the notices have not been adjudicated.

7. Copyright Ownership and Fair Use

All content on Exam-PDF, including but not limited to text, graphics, logos, and software, is the property of Exam-PDF or its content suppliers and is protected by copyright and other intellectual property laws, unless otherwise indicated.

We respect the rights of copyright holders and support the principles of fair use. If you believe that your work has been used in a way that constitutes copyright infringement, please follow the procedures outlined above.

8. Modifications to This Policy

We reserve the right to update or modify this DMCA and Copyright Policy at any time without prior notice. Your continued use of the website after any changes constitutes acceptance of the new policy[reference:11].
